Nakuru Senior Resident Magistrate Priscah Nyotah on Tuesday February 11, 2025 sentenced the duo to one year term jail each or pay fine of Sh 550,000.

Kimutai and Kipngeno were arrested on July 12, 2017, and charged on four counts before Senior Resident Magistrate Priscah Nyotah.
Nyota charged the duo of forging a family agreement on October 12, 2010, which allegedly transferred the 6.6-hectare land into their names.
That the two were guilty of forging the land title deed on November 14, 2012, with the intent to defraud Josiah Njoroge, the legitimate owner of the land.
The court also ruled that the two had forged a green card for the land on November 14, 2012, falsely claiming it had been opened on June 7, 1990.
The court further ruled that the two were found guilty of fraudulently obtaining the registration of the land in their names, with the intent to defraud Njoroge.
The case has taken over 7 years with several witnesses giving their testimonies among them Inspector Stephen Agutu.
The officer revealed that after investigations, it was established that Njoroge’s title deed issued on December 5, 1997, was genuine, adding that He insisted that the title obtained by Kimutai and Kipngeno on November 14, 2012, signed by then Land registrar Nyantika, was a forgery.
Last week Thursday February 6, 2025 Senior Resident Magistrate who was to deliver a sentence in the matter was postponed to today Tuesday February 11 as she had requested time to go through a pre-sentencing report.
Delivering the sentence on February 11,2025 , Nyota stated that the court had sentenced the duo to serve one year jail term or pay a fine of Sh 150,000 on 1st , 2nd and 3rd count and sh 100,000 on the 4th count.
“They are sentenced to 1 year jail term and a fine of sh550, 000. For count 1, the fine is Sh 150,000, for county 2, the fine is sh150, 000, for count 3, the fine is sh150,000, and count 4 the fine is sh100,000. So you have a right to appeal and the cash bail in the court can stand in for one count,” stated Notah.
