Court of Appeal on Tuesday October 13, 2026 declined Government’s bid to halt High Court orders in Safaricom shares sale case.
The Wiper Patriotic Front (WPF) and The Ukombozi Alliance (TUA), in a press release undersigned by Spokesperson, Wiper Patriotic Front (WPF) Ndegwa Njiru informed the public that Senior Counsel, Dr Stephen Kalonzo Musyoka, attended virtual proceedings.
That the Court of Appeal, comprising Justices Kimaru, Okello and M’Inoti, declined the
Government of Kenya’s application seeking a stay of the High Court orders issued on 15 September 2026, which declared the Safaricom shares sale “null and void”.
Consequently, the High Court orders remain in force pending the determination of
the substantive appeal.
According to WPF, the Government must now pursue its appeal through the established judicial process.
Senior Counsel Musyoka represented the petitioners, led by Tony Gachoka and
others, in the case challenging the transaction.
The petitioners have maintained that transactions involving strategic national assets must be conducted transparently, lawfully and in strict adherence to the Constitution and that the disposal of public assets must never be treated as an administrative formality.
They argue that such transactions must withstand constitutional and judicial scrutiny and, above all, serve the interests of the Kenyan people.
The Court of Appeal proceedings took place against the backdrop of Dr Musyoka’s engagements in the United Kingdom.
The WPF leader on Monday evening, delivered
a keynote address at the House of Commons to the Westminster Africa Business Group, in partnership with the Eastern Africa Association.
On Tuesday afternoon, Dr Musyoka was scheduled to deliver an address at Chatham House titled “The Opposition’s Outlook and Policy Agenda on the Road to the 10 August
2027 General Election.”
His address setting out the Opposition’s perspective on Kenya’s political and economic direction, democratic governance, and the
protection of the country’s national interests.
