Nakuru Politician Asumpta Wangui, 6 others file petition challenging public participation carried out on impeachment of DP Gachagua

Nakuru based politician and opinion leader Asumpta Wangui Muiruri and 6 others have filed a petition at a Nakuru High Court under certificate of urgency seeking to nullify the public participation conducted on the motion to impeach Deputy President Rigathi Gachagua.

Other petitioners in the case include Edward Kings Onyancha, Yusuf Ngunyi, Simon Sangale Nasieku, Ben Gathogo, Samuel Murage Karigitho and Johnson Kireru Mwangi.

The petitioners are seeking orders from the courts to nullify the alleged public participation conducted in all the Counties on October 4, 2024 and repeated in all the 290 constituencies on October 5, 2024.

In court papers seen by this writer, S Njoroge, The Clerk of National Assembly, Mutuse Mwengi and the Attorney General have been enlisted as 1st, 2nd, 3rd, and 4th respondents respectively.

The petitioners argue that the public participation breached every applicable relevant laws and violated each and every applicable relevant articles of the constitution of the republic of Kenya.

They further state that, the exercise lacked any tinge of civic education and had no notice mandatory under the applicable relevant laws.

Speaking to this writer via phone, one of the petitioners Asumpta Wangui Muiruri revealed that the exercise did not give chance to vulnerable groups such a as persons with disabilities(PWDs).

She further argued that the exercise also did not factor in members of Seventh Day Adventist Church who always attend service on Saturday.

“We are saying the exercise is null and void as there was no any civic education, and did not bring on board persons with disabilities (PWDs) and our SDA brothers and sisters,” she stated.

Hon. Lady Justice Hedwig Ong’undi is expected to give directions virtually in the matter on October 10, 2024.

This even as the impeachment motion against Deputy President Rigathi Gachagua has been moved to the Senate, which is expected to debate next week.
